Brother Sal Garcia #1959, ret Phx PD needs prayer for his granddaughter Jazmine. See his message below. For those who will please pray with me for Jazmine and the entire family.
 
Tom, my granddaughter Jazmine 13yrs, had knee surgery at Phoenix Children's Hospital yesterday
and it took the doctors 3 hours to remove the titanium knee and another 2 hours to install her replacement.
The doctors then checked her and found no pulse on her foot. They did an ultra sound then called for a
cardiovascular surgeon to see if they could get her pulse back into her leg.So back into surgery last night
for a second surgery to see what was going on. The doctors said her artery was really red, because of all
the chemo she had gone through the past two years. The doctor cut open her artery and found a blood
clot then the put in a stint in or plastic tube for better blood flow. This operation took another hour and
half Jazmine was put in ICU last night and my daughter Bernadette, Jazzy mom stayed with her.
Bernadette called this morning saying Jazmine still has no pulse in her leg. She needs a blood transfusion
because she is low in HG.
 
Gracious and loving Father there is nothing more precious to the adults in this world than our children and grandchildren. We always desperately want the best of health and strength for them that they may grow into a better adult than we are. At this time Father a brother Sal Garcia has a granddaughter who has undergone some very serious surgery and there is a sever problem with blood circulation in her leg that underwent the surgery. Father You know every cell in Jazmine's body and the exact cause of the problem. We come to You with love and worship to Your all knowing and perfect healing to be upon Jazmine healing all the surgical wounds and cleansing her blood arteries that her circulation will be returned to normal in Your perfection. As her healing progresses we seek Your wisdom and discernment to come into all medical personnel attending to Jazmine guiding all of their actions and treatments to accomplishing perfect healing through You. Father set Your loving grace into the hearts of all of Jazmine's family who at this time are having fears and sorrows from her condition. Let them feel Your presence in their hearts knowing it is from You and that Jazmine's recovery is in Your all perfect hands. We seek these things Father in the name of Your Son Jesus Christ. Amen.

Well, I must clarify my last e-mail concerning the Arizona State FOP Conference and our June FOP meeting.  Hope my wife is the only one who caught the mistake and the rest of you will understand the oooold age thing.
 
The Arizona State Conference will be held on June 26, 2011 and we will NOT be having a meeting on June 28, 2011 because of the conference.  Again we will not have a meeting tomorrow night.  Hope that clarify's my last e-mail.  Sorry for having to send out yet another one.  Just wonder how many will show up for the meeting?
 
Hope to see all of you at the next meeting on the 4th Tuesday of each month starting July 26, 2011.

                    "Shifty" By Chuck Yeager
                     

                    Shifty volunteered for the airborne in WWII and served with Easy  

                    Company of the 506th Parachute Infantry Regiment, part of the 101st  

                    Airborne Infantry.  If you've seen Band of Brothers on HBO or the  

                    History Channel, you know Shifty.  His character appears in all 10  

                    episodes, and Shifty himself is interviewed in several of them.   


                    I met Shifty in the  Philadelphia airport several years ago. I didn't  

                    know who he was at the time.  I just saw an elderly gentleman having  

                    trouble reading his ticket. I offered to help, assured him that he was  

                    at the right gate, and noticed the "Screaming Eagle," the symbol of  

                    the 101st Airborne, on his hat.   

                    Making conversation, I asked him if he'd been in the 101st Airborne  

                    or if his son was serving.  He said quietly that he had been in the  

                    101st.  I thanked him for his service, then asked him when he served,  

                    and how many jumps he made.   

                    Quietly and humbly, he said "Well, I guess I signed up in 1941 or so,  

                    and was in until sometime in 1945 ..." at which point my heart  

                    skipped.


                    At that point, again, very humbly, he said "I made the 5 training  

                    jumps at Toccoa, and then jumped into  Normandy . . .  do you know  

                    where  Normandy is?"  At this point my heart stopped.

                    I told him "yes, I know exactly where  Normandy is, and I know what  

                    D-Day was."  At that point he said "I also made a second jump into  

                    Holland , into  Arnhem ."  I was standing with a genuine war hero ...   

                    and then I realized that it was June,  just after the anniversary of  

                    D-Day.   

                    I asked Shifty if he was on his way back from  France , and he said  

                    "Yes...  And it 's real sad because, these days, so few of the guys are  

                    left, and those that are, lots of them can't make the trip."  My heart  

                    was in my throat and I didn't know what to say.



                    I helped Shifty get onto the plane and then realized he was back in  

                    coach while I was in First Class.  I sent the flight attendant back to  

                    get him and said that I wanted to switch seats.  When Shifty came  

                    forward, I got up out of the seat and told him I wanted him to have  

                    it, that I'd take his in coach.


                    He said "No, son, you enjoy that seat.  Just knowing that there are  

                    still some who remember what we did and who still care is enough to  

                    make an old man very happy."  His eyes were filling up as he said it.  

                    And mine are brimming up now as I write this.



                    Shifty died on Jan. l7 after fighting cancer.


                    There was no parade.

                    No big event in  Staples   Center .

                    No wall-to-wall, back-to-back 24x7 news coverage.

                    No weeping fans on television.

                    And that's not right!


                    Let's give Shifty his own memorial service, online, in our own quiet way.

                    Please forward this email to everyone you know.  Especially to the veterans.   

                    Rest in peace, Shifty.

I am passing on info regarding a book written by Mark Williams retired from LE who is offering the book at 50% off.  I personally have read the book and enjoyed it and I believe most of you would as well.  No I don' get a commission, I just try to keep people up to date.
 
Also attaching a note from Sheryl Berentz about a fundraising concert in Snowflake on the 15th of July and information about her husband John writing a book.  I have not had the chance to read the book yet but looking forward to it.  Sheryl is retired from MCSO and John retired from PPD.  Now for the good news, as soon as I quit PROCRASTINATING you can read my book too. Yes that was a big word for me and I did not even need spell check.
 
Don't forget to check out our web site at www.azfop5.com for updates on Retiree Breakfast and things that may be of interest to all of you.  Our West Side breakfast on the 3rd Tuesday showed a couple of new/oooold faces and as I was leaving the parking lot I ran into Pete Sanchez also retired from MCSO.  Pete was pre-historic computer so does not have an e-mail address but will try to attend the next breakfast.
 
Hope all of you had a fantastic Fathers Day holiday and for those of you who still have one give them a call and tell them how much you appreciate them. 
 
Finally, I had a meeting a couple of weeks ago with Sheriff Arpaio and Chief Deputy Jerry Sheridan.  I will write more on that meeting later as I felt it was productive in improving the relationship and communications between the Sheriff's Office and the Fraternal Order Of Police.
 
Arizona State FOP Conference will be starting on July 26th and we will not have a meeting in July.  Repeat WE WILL NOT HAVE A MEETING IN JULY.  Hope to see all of you in August.

Thank you very much for the plug. You bet we can use it.  Whoa..John just finished publishing his first book. We have copies hot off the press! Don't know if anyone might be interested but it is a "true" crime autobiography of his undercover operations while he was with Phoenix PD. This is book number 1 (he tells me) of a series coming right out of Phoenix PD and oh boy, it does tell all!

 

Mike, I put up a simple web site today so if anyone would like to get a copy or just pick up information about it they can do so online. The web address is www.johnberentz.com    The book costs $10 bucks. If they order online there is a $3.50 charge for shipping. (Envelope to ship+postage).  If anyone plans to be in our area, we'll be glad to meet them to save that $3.50 if they want! Shoot, we might even buy the coffee just to be able to visit a bit! I hate to say it but my hubby did a very nice job on this book and so far, everyone who has read it says they're fascinated from the minute they pick it up until they finish reading it. I was fascinated as well and shoot, I lived a bunch of it with him. Guess I am prejudiced, but he did do a nice job! Get back on this mountain Mike before it burns up! We now have a fire up in the gorgeous bear canyon lake area just outside Forest Lakes. What a shame. My brother's ashes are scattered up there. It is with double regret that I am so sad to see another "burn" on this mountain. We have had "zero" weather so there is no doubt that this additional wildfire is man-caused, it could not have been a lightning strike. What a shame.

 

Anyway, we hope to see you for the concert! No, John won't be singing.YET! He is learning to play bass guitar though so I hope that soon he will be playing in our performances instead of just managing them! Course, if he becomes a famous author.he won't have time to mess with us little singing people! Have a great day!

Hi Amy- My last email was somehow sent blank so here it is again. Please forward this to Lee or April as I don't have their emails. Our meeting went well and the cabinets are almost complete. I am super excited about the color/ style and manufacturer change. I noticed an option on the 3400 model option sheet that I hadn't considered before. Pull out shelves in the lower cabinets of the kitchen is about $1000. So here is my question. We have already paid to change almost half of the lower cabinets so there are much fewer to change to pull out than the typical 3400.
 
Here are the changes we have already made:
 
The kitchen island:  We removed half of the cabinets to change out to legs.
The "desk" area: Eliminated all bottom cabinets. (They are now drawers and open area)
The opening left of sink: We changed it to a pull out trash can.
The area right of stove: We changed half of to baking pan storage
 
Because of these changes we will need just over half the number of pull outs than was previously there.  The only other cost we are waiting for are the spice/ utensil pull outs. Thank you for considering our request. ~Michelle and Chris 480-283-7333

            Recently, the Chula Vista Police Department ran an e-mail forum (a question and answer exchange) with the topic being, "Community Policing."

            One of the civilian email participants posed the following question, "I would like to know how it is possible for police officers to continually harass people and get away with it?"

            From the "other side" (the law enforcement side) Sgt. Bennett, obviously a cop with a sense of humor replied:

            "First of all, let me tell you this...it's not easy. In Chula Vista,  we average one cop for every 600 people. Only about 60% of those cops are on general duty (or what you might refer to as "patrol") where we do most of our harassing.

            The rest are in non-harassing departments that do not allow them contact with the day to day innocents. And at any given moment, only one-fifth of the 60% patrollers are on duty and available for harassing people while the rest are off duty. So roughly, one cop is responsible for harassing about 5,000 residents.

            When you toss in the commercial business, and tourist locations that attract people from other areas, sometimes you have a situation where a single cop is responsible for harassing 10,000 or more people a day. 


            Now, your average ten-hour shift runs 36,000 seconds long. This gives a cop one second to harass a person, and then only three-fourths of a second to eat a donut AND then find a new person to harass. This is not an easy task. To be honest, most cops are not up to this challenge day in and day out. It is just too tiring. What we do is utilize some tools to help us narrow down those people which we can realistically harass.

            The tools available to us are as follows:

            PHONE:  People will call us up and point out things that cause us to focus on a person for special harassment. "My neighbor is beating his wife" is a code phrase used often. This means we'll come out and give somebody some special harassment.

            Another popular one is, "There's a guy breaking into a house." The harassment team is then put into action.

            CARS:    We have special cops assigned to harass people who drive. They like to harass the drivers of fast cars, cars with no insurance or no driver's licenses and the like. It's lots of fun when you pick them out of traffic for nothing more obvious than running a red light.  Sometimes you get to really heap the harassment on when you find they have drugs in the car, they are drunk, or have an outstanding warrant on file.

            RUNNERS:         Some people take off running just at the sight of a police officer. Nothing is quite as satisfying as running after them like a beagle on the scent of a bunny. When you catch them you can harass them for hours.

            STATUTES: When we don't have PHONES or CARS and have nothing better to do, there are actually books that give us ideas for reasons to harass folks.  They are called "Statutes"; Criminal Codes, Motor Vehicle Codes, etc...  They all spell out all sorts of things for which you can really
            mess with people.

            After you read the statute, you can just drive around for awhile until you find someone violating one of these listed offenses and harass them.  Just last week I saw a guy trying to steal a car. Well, there's this book we have that says that's not allowed. That meant I got permission to harass this guy. It is a really cool system that we have set up, and it works pretty well.

            We seem to have a never-ending supply of folks to harass. And we get away with it. Why? Because for the good citizens who pay the tab, we try to keep the streets safe for them, and they pay us to "harass" some people.

            Next time you are in my town, give me the old "single finger wave."  That's another one of those codes. It means, "You can't harass me." 

             

            It's one of our favorites.

Please oppose HB 2650. Having law enforcement officers as 'at will' employees is bad public policy. Law enforcement by its nature is going to generate complaints. Without the protection of a merit system officers will be either be fired for political gain or they will not carry out their duties impartially for fear of reprisal. In the long run this will lead to patronage and corrupt officers, adminstrators and whole agencies.
Please oppose any efforts to make law enforcement employees 'at will'.

A couple of questions;
Is the Pool "threatening" to automatically appeal an award if they are not allowed to argue causation?
Didn't the August 2010 conference call put everyone on the same page as to being a damages only hearing?
 
Additionally, buried deep in their motion they state that one of the reconstructionists said that Croswell was moving at appx 10 mph. He was not stopped and established in the turn lane, the position of the vehicles post collision also confirms that both were in motion albeit at different speeds. Hopefully we dont have to pursue that issue.

Do you still think they will deny the most recent motion? If they lose, are they able to tie this up with an appeal to superior court ( either before or after the hearing?)?

It was odd that the economist spent so much time arguing about medical issues. To clarify, the physical requirements to get hired and/or lateral transfer are seperate from the AzPost minimum standards. The mile and a half run, push ups, sit ups etc are arbitrary and wholly unrelated to being fit for duty. These requirements exist solely for the hiring process and "up the ante" for the competition.
 
While the time(s) for the run and number of sit ups and push ups etc do not vary greatly from agency to agency, AzPost does not recognize nor require the same standards. AzPost requires a very specific obstacle course followed by a 165lb dummy drag and a sprint just under 1/4 mile. The AzPost course is not used during the hiring process at any agency to my knowledge.
 
It is not only possible but common that an Officer will meet the AzPost duty requirements but not meet the fitness standards as required by a hiring agency. Additionally, my employer is fully aware that I cannot run for an extended period with out severe discomfort, the same for sitting, standing etc. This is the primary reason I had to leave SWAT, there are times when on a mission we will be in a shooting position or sitting on a perimeter for several hours. Currently it is the extended time periods of any activity that cause discomfort.
 
In short, the economist is wrong to assume that if you are fit for duty, you meet the hiring requirements.
 
I will read the Nurse's depo and respond shortly.

Good Morning- I just faxed the Social Security form and a few medical bills. The last question on the form had the accident date listed wrong so I changed that. I did not list who has paid the bills to date because I am not sure who did? It should be whoever the city has as their workman's comp. carrier. I have also attached $75,248.33 in medical bills.  There is also a list of missing bills in case you needed to track any down. Still missing is Dr. Weiner (original surgeon), Dr. Rhorer, CT scan with Simon Medical, Physical Therapy post 7-14-08 at Skyline, medical equipment from Johnson Medical, equipment from Arizona Mobility, Physical therapy from KC Physical Therapy. pain meds and Lovenox shots.

2008- Income AJPD: $43,709.29 Off duty net profit $2,000 (from January to accident 2/15/08)
2009- Income AJPD: $52,133.74(includes promotion to corporal) Off duty net profit $387

I did not attach 2006. I did not become eligible for off duty until the end of the year. I had to be out of academy and off probation.

No, if Monday is a Holiday and I work Wed-Sat I get paid my 40 hours plus 8 hours of Holiday pay (at time/half). If Monday is a holiday and I work only 30hours, I get paid 30 hours straight time, the 8 hours of holiday end up being straight time and to get 40 I would have to use 2 hours of vacation/personal/sick time.
So if you have a holiday and work 40 hours either on or off the actual holiday you get 8 hours of OT. If you have less than 40 hours of regular time they start subtracting the holiday hours and paying them at straight time till you get to 40 then OT wages start up again over 40.
 
To really make it confusing, if we take vacation on a holiday week, we dont get holiday pay. They put the vacation hours back into our bank and pay us straight time for the holiday. They dont count vacation hours as time worked.

Apache Junction: Hours worked only count towards the 40 hours in a set week. So if you work Wed-Sat normally and pull a shift on Monday for OT, its not OT until you get over 40 by completing your four regular shifts. ie if you work "OT" on Monday but then call off on Sat, you still only bill 40hours.
 
Holiday Hours, we only get 8 hours of holiday even if we work on that holiday. However, if you dont work that holiday you still get 8hours provided you booked 40 hours during the week the holiday fell.

OT:  Does your agency pay you OT for hours worked in excess of 40 hours or OT for hours earned over your normally scheduled 40 hours?  For example, if you work a shift outside of your normally scheduled workweek (before you have 40 hours in) would you receive OT pay for those hours or does it only count toward your 40 hours?

Holiday Pay:  How many holiday hours do you receive for working a holiday.  Do you receive 10 hours of holiday pay for a 10 hour shift or only receive 8 hours for a 10 hour shift, etc.  Do you have to use other hours (whether vacation, medical, or comp time) to complete your shift if you receive less than a full shift of holiday pay.

I have the other information I need but input from you guys will help on these two subjects.......

AZ FOP Discussion List.......... Scottsdale FOP Lodge #35 is looking for FOP members to show up at a city council meeting on Monday, Dec. 13th.  Time is yet to be determined by the City, but should start around 4-5 pm at our City Hall. 

Scottsdale has been the testing ground for groups wanting to limit or remove employee benefits, pay, pension issues, and basically anything that we as employees have come to know as reasonable pay and benefits for a reasonable days work.  The battle we have been fighting in Scottsdale over the last year is coming to your jurisdiction soon.  The talks of privitization, over-paid and over-benefitted employees have now spread to Phoenix and is starting in other Valley cities.

Do not think that your membership will be immune from this fight.  There is an all out assault on the pay and benefits that we have all worked so hard to gain.  This will be an extremely tough and important year for all of us. 

There will be a good number of active and retired Scottsdale employees at the meeting, but I am looking for non-Scottsdale FOP folks to be there to help out with some good old union activities at the meeting.  I will not go into details here on the board, but it is nothing illegal or immoral, but is designed to get the attention of the people who need to focus on what is important.  The meeting will hopefully not take more than a few hours of your time and I know a FOP friendly place we can go after for food and drinks.

I expect there will be occasion for Scottsdale to return the favor of showing up at your battles in the future as they WILL occur.

If you would like to show up and help, please email my VP Doug McCumber at dmac334@aol.com.  I will provide more information to attendees as the date gets closer...

The police officer and the firefighter are confused and I'm no help because I'm confused, too.

 

Each time a spoiled professional athlete signs a multimillion-dollar deal, folks come out of the woodwork to say that our priorities are screwed up and it should be cops, firefighters and teachers who earn that kind of money.

 

From there we've gotten to a place where first responders worry that some people now think of them as spoiled and greedy for the pensions they receive.

 

"It surprised us," said Tim Hill of the Professional Fire Fighters of Arizona.

 

As part of The Arizona Republic's recent series of articles on public pensions, a number of egregious examples were cited of folks who are taking advantage of the public retirement system to enrich themselves.

 

"But that is not our members," said Jim Mann of the Fraternal Order of Police. "The people milking the system come from the top of the organizations. The higher-ups. Not from the men and woman who patrol the streets."

 

Hill was angered as well by comments from Byron Schlomach of the Goldwater Institute who told The Republic's Craig Harris, "It's nice they have figured out a way to rob us. This is ridiculous. How can anybody justify this?"

 

"That's not the officers in the field," Hill said. "That's only a few people getting special treatment."

 

There were other issues as well.

 

"We have had eight deaths in the past few years, and the oldest was 52," Hill said. "When firefighters are hired, they are super healthy. And they try to stay that way because how else are you going to carry Grandma from the back room of the house to the front door where the gurney is? But we have lots of injuries. We die younger. We see rare cancers. We see cardiac problems in people in their 40s."

 

Firefighters and police officers are known as "industrial athletes." And like other professional athletes there is only so long a body can handle the job, assuming their careers are not cut even shorter due to injuries.

 

"My opportunities are limited after I leave the profession," Hill said. "You can't go and be a firefighter in the private sector. Add to that that most of our members won't be getting Social Security like other folks and maybe people wouldn't jump to wrong conclusions."

 

The Republic series pointed out some blatant examples of people enriching themselves at the cost of taxpayers. Public officials. Education administrators. Even former felons.

 

"A lot of this criticism of pension systems for public employees is simply an attempt to undermine those systems completely," Mann said. "To gut them. And that could be a terrible mistake. If we have learned anything it is that public safety depends on the government's ability to attract and retain good people."

 

He points to the decrease in job vacancies and subsequent increase in safety and efficiency in the state's prison system after the Legislature put corrections officers into the system.

 

I also heard from several officers who were angered by one article in the series that listed Scottsdale retirees and family members receiving the highest annual pension benefits. Included on the list was Cathy Hontz, wife of Scottsdale police Sgt. Thomas Hontz, who died during a training accident. She is an obviously innocent victim, and the officers were upset she was included on the list. "Discussing financial concerns over a pension program is fine," one officer told me. "But putting a widow in there? That's (expletive)."

 

Or, as Mann added, "When an officer dies in the line of duty, the surviving spouse receives a 100 percent pension. In other words, you get your husband's salary at the time he died. So, is that now considered enriching yourself?"

I am looking for pay information from all departments in the valley as well as Tucson PD.  What I need to know is, do new hires receive regular pay increases such as Step Pay or Merit Pay.  If so is it on a yearly basic and how many years does it take to reach top officer pay.  I also would like to know if your officers are still getting this pay or has it be frozen in the last year due to budget cuts.  I am receiving conflicting information and know the best info would be from my fellow officers who work at these different department.  The sooner I can get this information the better.  We are meeting with the city in the next week to discuss these issues.

Good Morning,
I am not sure what you would like an opinion on in regards to the SW Letter. I see that there is a difference in what was billed ($160k) and paid ($90k). I don't think they should base their offer from the negotiated payment amount but we'll see.
 
The offer to split the 15k is sending a mixed signal. On one hand they are agreeing to share and that a significant injury ocurred and that seems to be in our favor. However, they almost have tone of 'if you don't take this offer future benefits are in jeopardy' with the last sentence(s) of paragraph two. I don't take issue with their offer as I had assumed that the entire amount from Croswell was under a WC lien.

Governor names new director of DPS

Associated Press - January 13, 2010 4:04 PM ET

PHOENIX (AP) - Gov. Jan Brewer Wednesday named a new director for the Arizona Department of Public Safety.

Brewer named Robert Halliday to lead the state police.

In a news release, the governor's office said Halliday was the Commander of the Emergency Operations Center where he established emergency protocol procedures through placement and training of skilled individuals.

Before that, Halliday was commander of the Arizona Counter Terrorism Information Center from 2004-2007.

The governor's office said Halliday has 37 years of law enforcement service with over 35 years at DPS.

He replaces Roger Vanderpool who will continue to serve as DPS director through Jan. 31.

Good Morning,
I wanted to forward to you an example of the excellent work being completed by Officers Selman and Denman. On 09/17/09 at approximately 0323 hours, Officer Selman observed a red chevy truck in the drive through at Jack in The Box. There were was nothing remarkable about the vehicle except for the time of day it was out. Officer Selman alerted Officer Denman of the truck as they had prior contact with a similar vehicle and knew from that contact that current PC existed for a female known to be a regular passenger in the truck.
 
Officer Selman parked across the street and waited for the truck to exit the drive through and had Officer Denman park at Delaware/Apache Trail. Instead of leaving the business, the truck parked out front. Both Officers then approached the truck for a field interview. Prior to going to the truck Officer Selman contacted Detective Ramirez by telephone and confirmed the PC as it was no longer listed on the daily comm- board, mostly because the case is over a year old.
 
Caitlyn Janke was arrested for PC on AJPD DR#080413006 and held for Detective Ramirez.
 
Officers Selman and Denman are an asset to the Department and Community due to their excellent work habits.
