    The photos are of an officer trained in hand-to-hand combat.

    The officer figured, due to his size and fighting skills, he could disarm a knife wielding aggressor.

    Here is why I am forwarding these on.

    To all the idiots out there who always say, "Why did the cops have to shoot him?  He only had a (insert your choice of weapons here, i.e. knife, bat, club. whatever).  He didn't have to be shot.

    To that, I respond, "tough crap ... shoot'em".

    If an officer tells you to drop your weapon, just drop it.

    If you're a retard, stupid, on crack, mental or just "scared" ... too bad.  No one deserves what this cop got for just doing his job.  If you've got a knife, then you should die ... period.

    This is vivid proof of how deadly people who are "only armed with a knife" can be.  Some of the public think that officers should try to disarm someone armed with a knife but anyone who has had training in knife fighting will tell you - even if you win you are going to get cut.

    Keep this in the back of your mind when confronting someone armed with an edged weapon.

        The Fraternal Order of Police and Sheriff's Association for the Pima County Sheriff's Department does NOT solicit funds from the public.  Any funds received for these organizations are done by the citizen first contacting the organization. 

            * Be wary of solicitations that purport to be for policemen or firefighters. Con artists often make up names of phony police or fire associations.  If you receive a call like this, call your local police department or fire department to find out if it is soliciting money from the public.
            * If you believe the caller is trying to defraud you, call 911.
            * Ask for the caller's name, the address and the phone number.  

        Please know that identity theft is on the rise, and your personal information needs to be protected at all times.  A skilled telemarketer can extract information that an unsuspecting victim may not even realize.  Do not provide any personal information over the telephone.

        Using common sense will decrease your chances of being scammed.

        I’m Arizona State Senator Sylvia Allen. I want to explain SB 1070 for which I voted yes. Rancher Robert Krentz was murdered by the drug cartel on his ranch a month ago. I participated in a senate hearing two weeks ago on the border violence, here is just some of the highlights from those who testified.

        The people who live within 60 to 80 miles of the Arizona/Mexico Border have for years been terrorized and have pleaded for help to stop the daily invasion of humans who cross their property . One Rancher testified that 300 to 1200 people a DAY come across his ranch vandalizing his property, stealing his vehicles and property, cutting down his fences, and leaving trash. In the last two years he has found 17 dead bodies and two Koran bibles. Another rancher testified that daily drugs are brought across his ranch in a military operation. A point man with a machine gun goes in front, 1/2 mile behind are the guards fully armed, 1/2 mile behind them are the drugs, behind the drugs 1/2 mile are more guards. These people are violent and they will kill anyone who gets in the way. This was not the only rancher we heard that day that talked about the drug trains. One man told of two illegal’s who came upon his property one shot in the back and the other in the arm by the drug runners who had forced them to carry the drugs and then shot them. Daily they listen to gun fire during the night it is not safe to leave his family alone on the ranch and they can’t leave the ranch for fear of nothing being left when they come back.
        The border patrol is not on the border. They have set up 60 miles away with check points that do nothing to stop the invasion. They are not allowed to use force in stopping anyone who is entering. They run around chasing them, if they get their hands on them then they can take them back across the border. Federal prisons have over 35% illegal’s and 20% of Arizona prisons are filled with illegal’s. In the last few years 80% of our law enforcement that have been killed or wounded have been by an illegal. The majority of people coming now are people we need to be worried about. The ranchers told us that they have seen a change in the people coming they are not just those who are looking for work and a better life.
        The Federal Government has refused for years to do anything to help the border states . We have been over run and once they are here we have the burden of funding state services that they use. Education costs have been over a billion dollars. The healthcare cost billions of dollars. Our State is broke, $3.5 billion deficit and we have many serious decisions to make. One is that we do not have the money to care for any who are not here legally. It has to stop.
        The border can be secured. We have the technology and we have the ability to stop this invasion. We must know who is coming and they must come in an organized manner legally so that we can assimilate them into our population and protect the sovereignty of our country. We are a nation of laws. We have a responsibility to protect our citizens and to protect the integrity of our country and the government which we live under. I would give amnesty today to many, but here is the problem, we dare not do this until the Border is secure. It will do no good to give them amnesty because thousands will come behind them and we will be over run to the point that there will no longer be the United States of America but a North American Union of open borders. I ask you what form of government will we live under? How long will it be before we will be just like Mexico , Canada or any of the other Central American or South American country? We have already lost our language, everything must be printed in Spanish. We have already lost our history, it is no longer taught in our schools, and we have lost our borders.
        The leftist media has distorted what SB 1070 will do. It is not going to set up a Nazi Germany. Are you kidding? The ACLU and the leftist courts will do everything to protect those who are here illegally, but it was an effort to try and stop illegal’s from setting up businesses, and employment, and receiving  state services and give the ability to local law enforcement when there is probable cause, like a traffic stop, to determine if they are here legally. Federal law is very clear, if you are here on a visa you must have your papers on you at all times. That is the law. In Arizona all you need to show you are a legal citizen is a driver license, MVD identification card, Native American Card, or a Military ID. This is what you need to vote or get a hunting license. So nothing new has been added to this law. No one is going to be stopped walking down the street.  The Socialists who are in power in DC are angry because we dare try and do something.The Socialists wants us to just let them come. They want the “Transformation” to continue.
        Maybe it is too late to save America . Maybe we are not worthy of freedom anymore. But as an elected official I must try to do what I can to protect our Constitutional Republic . Living in America is not a right just because you can walk across the border. Being an American is a responsibility and it comes by respecting and upholding the Constitution, the law of our land, which says what you must do to be a citizen of this country. FREEDOM IS NOT FREE.

I'll be out of town until 7/12 and only back for a day or two and will be out of town again until 7/18 or so.  We should get together to review things.  Did you get my last e-mail?  I'm not sure what Ken Magoch is doing with his Constitution and By-Law change.  It will help the State Lodge no doubt, but it will kill us (his own lodge included).  We need to have the contract signed before the State Conference.  Maybe we should see if Xentel will give us a five year contract.  If his change passes it will hurt our efforts with CDG flooding the market.

I know the replacement ballot was mailed on Monday, December 7th.  Unfortunately we cannot count on the Postal service to be efficient.  If the by law change passes are you willing to pay dues of $50 a year?  That breaks down to about $4.16 per month.

FOP PRESIDENT DEFENDS AZ LAW ENFORCEMENT
Profiling Charges are “Offensive”

Chuck Canterbury, National President of the Fraternal Order of Police, stated his strong support for law enforcement officers in Arizona, who will soon be charged with enforcing the new State statute to combat illegal immigration and human trafficking.

“Our members in Arizona are justifiably offended with some of the assumptions that have been made by the media, pundits, and even elected officials who insinuate or state outright that these professional law enforcement officers will use the new law as a pretext to engage in unlawful racial profiling,” Canterbury said.  “They are angry and rightly so.”

The statute, Arizona Senate Bill 1070, the Support Our Law Enforcement and Safe Neighborhoods Act, has been criticized by many outside of the State as being too harsh or unfair to persons unlawfully present in the United States and Arizona.  From the perspective of Arizona law enforcement officers, it is extremely offensive to suggest that the law means officers will engage in racial profiling.

“Honest policy differences are both healthy and expected in the public forum, but some critics have really crossed the line,” Canterbury said.  “In their haste to criticize the law, I do not think they have stopped to think that its very insulting to law enforcement officers to hear that they will engage in biased policing, as if these officers do not understand the concept of reasonable suspicion or probable cause.”
                                   
The law, which will go into effect this summer, obligates officers to make an attempt, when practicable, during a lawful stop to determine the individual’s immigration status if there is
a “reasonable suspicion” that the person is in the United States illegally.  The individual may be arrested if there is probable cause to believe that their presence is unlawful.

“Law enforcement officers are trained in the police academy to recognize reasonable suspicion and probable cause,” Canterbury said.  “These officers put their lives on the line for the public–we entrust them to make life and death decisions in a fraction of a second.  You do not have to attack the law by attacking the integrity of these brave men and women.”


Milder critics of the statute argue that officers in Arizona will need additional training to ensure that they do not engage in racial profiling.  The Arizona FOP State Lodge rejects this claim, stating that what is truly needed is additional funding for the 287(g) program, which provides State and local law enforcement with training and the authorization to identify, process, and when appropriate, detain persons they encounter during their regular, daily law-enforcement activity who are illegally present in the United States.

“This is a very unique and detailed training that cannot be taught in a 60 to 90 minute video,” said Bryan Soller, the State Lodge President of the Arizona State Lodge, said of the 287(g) program.  “We need a clear direction on what proper documentation is, how to recognize forged documentation, the proper questioning format, and how to complete the proper ICE forms.”

“One of the genuine concerns that law enforcement does have with this new law is its potential costs,” Canterbury said.  “Whatever these costs are, local governments, which are already on very tight budgets, will bear them.”

“The one thing I do know is that the Arizona law enforcement community will find a way to make SB1070 work,” Soller said.

Why would you ever say Brandon and I and the FOP are not interested in contract issues?  Didn't I go to your office and initiate contact on this topic?  Haven't we come to you about these items?  I know Brandon has been on the local news explaining the FOP's stance on the current Political and contractual situation. 
I have tried to make it abundantly clear that we were not interested in taking over the negotiations but rather we are here to assist.  That doesn't mean we aren't interested.  I have told you that there were a multitude of resources available through the FOP that TPOA just doesn't have, because we want what is best for the members of the Tucson Police Department.  I have tried to mend some fences and make it possible for the FOP to be the valuable asset it is for the members of our department.  We are not complacent or disinterested.

On a personal level I have told you I wouldn't want to be in your situation.  I still wouldn't.  TPD members have never had pay cuts or furlough days during the history of the department.   Even when you do your best it is still going to criticized because of the losses incurred.  Your job sucks, but that doesn't mean I am not going to be interested in what you do contractually and politically.  I want you to do well and support your efforts.  I cannot ignore the financial losses suffered from contract negotiations during my time with TPD.  It is something that I cannot ignore because of the effect it will have on me and my family for the rest of our lives.

You know I really do support you in your current fight.  The FOP can still be a valuable asset.  We need to fight this fight together.  I am sorry there has been some misunderstanding between you and Lorraine.  She and the other retired members can be the greatest asset we currently have.  Consider the wisdom, experience, political contacts, and mostly the TIME they can contribute.
I hope you can clear this up.

I went to the gym today and spoke to Mike Romero a Captain with TFD. He was telling me that he was at a Command Staff meeting involving TFD members. The new TFD Chief was asked point blank if he would be willing to take a pay cut to save the jobs of other firefighters. His response was NO I am a Department Head and if my pay is cut I will leave. He was also asked if probation employees should begin to look for other jobs and he told them no....There also is a very real trust issue with Roger (TFD Union President). Tonight, John Strader and I met with every Department Heads, Tucson Firefighters Association Executive Board members, the two civilian labor group leaders, and the city managers to discuss emergency budget cuts to address a $32 million dollar gap in this fiscal year's budget. The meeting lasted for several hours and had to be adjourned until tomorrow at 1100 hours. As it stands right now, we have been in a real dogfight with various ideas and interests and some of the options are still on the table until they can be finalized tomorrow. It is our intent to keep you informed as soon as information is finalized and plan on sending a message out following tomorrow's meeting.

Will Illinois FOP endorse Obama again?

The Illinois FOP (Fraternal Order of Police), Illinois's most powerful police union, endorsed Obama when he ran for Senator in 2004, citing his willingness to sit down and compromise on legislation and his staunch support of gun control measures to keep illegal guns off the streets.  While this might not be a big deal in Illinois (after all, the IL FOP endorsed Democrat Dan Hynes in the primary election), there are many states where police unions almost ALWAYS endorse whatever Republican is running for office at the time.  Without fail, and usually without reason, these unions will endorse against their best interests just to attach their name to the Republican who is running.

As a member of the police community, I find that a large majority of officers tend to lean Republican.  I can't even tell you how many times I've had to correct people in my own department about whether or not Barack Obama is:

A) a muslim
B) a terrorist
C) won't salute the flag
D) think of every other maliciously viral chain email you've ever received and put it here.  

It can be down-right annoying.  In fact, it can be pretty disheartening.

In fact, here's a snippet of what I deal with on a daily basis (this is from an actual conversation with one of my supervisors):

HIM:  I don't know why anyone would vote for Obama.  He's a muslim extremist.
ME: What?!  No he isn't!
HIM:  Yes he is!  He went to a muslim Madrassa and his dad is a muslim.
ME: UGH!!!!!!!!!!!!!! **palm smacks forehead**
HIM: He also won't participate in the pledge and I read that he got sworn in on the Koran.

I also post on a New Jersey police officers' message board, where roughly 90% of the participants are rabid McCain enthusiasts.  Yesterday there was a thread started about how Obama located the portable toilets from his huge Oregon rally right ON the police memorial.  There was this picture accompanying the post:

PORTLAND, OR – Police officers in Portland, Oregon, are still waiting for an apology from Barack Obama after campaign staffers of his recent rally in Portland, Oregon, setup porta potties directly on top of the Portland Police Memorial, which honors the agency’s 25 fallen police officers.

The Obama rally drew a crowd of over 75,000 people.

Officer Thomas Brennan, who was working overtime at the rally, took a picture of the offending toilets, with the American flag still at half mast because of Police Officers Memorial Day, directly behind them. The local law enforcement memorial service had been held at the site only five days earlier.

Despite a large amount of open areas in the vicinity, the campaign staffers claimed the toilets were placed on the memorial for safety reasons to accommodate wheelchair access.

The Obama campaign has not responded to requests for an apology.

Most police officers who have heard/read this story, or have simply seen the photograph, react as if they were personally wounded.  And, admittedly, I can understand why.  The job is dangerous, and every officer attends a fallen comrade's funeral at some point in his or her career.  I've been on the job for 4 years and I've been to at least 6 police funerals.  When we think of a police memorial, we consider it hallowed ground.  It's not the kind of place you should desecrate by placing a portable toilet on top of it.  

But here's the problem...

What these rabid Republican brothers-in-blue believe (or at least, shout out into the void), is that Obama should be held directly responsible for this gross act of negligence.  It's as if they believe Obama to have operated the crane that lowered the toilets onto the police memorial himself.  In fact, it was most likely event staff who were not associated with the Obama campaign at all.  And from what I gather, it has been common practice to place portable toilets near the police memorial to accommodate wheelchairs.  Perhaps it was the city event planner's fault.  But regardless of whose fault it was, I think it's certainly a stretch to directly, or even indirectly, Barack Obama, or the The Decemberists (who played before his speech).

While any Democrat will run into problems obtaining the vote of the police community, these are the types of distractions that solidify Obama's image problem with them.  

And amid all this controversy, the Illinois FOP has remained silent.  It's apparent that they still support Senator Obama.  They recently posted an Obama press release on their website.  But they are in a unique position as an important law enforcement advocacy and fraternal organization and union.  If the Illinois FOP were to publicly endorse Barack Obama for President of the United States, it would go a long way in helping to improve his image among law enforcement officers across the nation.  They could also help by issuing a press release about the recent portable toilet debacle, and help put to rest the bee's nest that's errupted in the police community around this incident.   The Illinois Fraternal Order of Police, with a little bit of PR, can really help to shift the police community's misperceptions about Obama.

It's for these reasons that I'm asking you to contact the Illinois FOP, and tell them, politely and with grace, that they could be a huge help.  I honestly believe, with just a little PR, and a few endorsements, we can get a lot of votes from disaffected Republicans, independents, and Democrats within the law enforcement community.

Hi Robin!  The dishonesty coverage and the liability coverage are two separate issues.  The dishonesty coverage that you currently have is on an Old Republic Bond with an annual premium of $179.00.  This bond premium is fully earned and is due to expire on 12/21/04.  I have estimated the premium to add this dishonesty coverage to your Cincinnati policy written through Mueller to be an annual premium of about $125.00.  There is currently no duplication of dishonesty coverage.  I recommend you transfer the dishonesty coverage to the Cincinnati policy on 12/21/04 to use up the premium you have already paid on the bond.
 
Now to address the only duplicate coverage I am aware of.  FOP Lodge #1 had a general liability policy with Burlington through TGA (Brown & Brown, Tucson) that was effective from 3/7/04 to 3/7/05.  You requested this policy be cancelled effective 6/7/04 (because the policy had a 25% minimum earned premium), as this coverage is also provided by the Cincinnati general liability.  Because the Burlington policy was written with Brown & Brown, Brown & Brown would be the agency to provide FOP Lodge #1 at PO Box 17629  Tucson, AZ    with any return premium due (and the final cancellation notice).  Please check with Brown & Brown to see if final cancel effective 6/7/04 has been processed by TGA.

   Hello NIck, good to hear from you.  Thanks for the picture showing Pat and Frank Eyman.  I have done a lot on research on Frank.  I spent days with him in the early 1970's interviewing him about history.  I asked him why he never did a history book and he replied he was too busy making history.  He played an important roll in the capture of the John Dillinger gang here in Tucson in 1934.  For months I have been working with the Historical society and TPD writing the history/story of TPD and how Dillinger was captured here on January 25, 1934.  F Y I, there will be a big 3 day display here in January. TPD will be involved: Here is what is going to happen.  There will be a three day display with pictures and a story line in the Wells Fargo Museum downtown.  I picked out 51 pictures and I wrote the story.  Terry Rosma, will coordinate getting the machine guns from TPD to the museum each day, plus there has to be an officer with the guns all the time they are on display.  There will also be lectures at the public library, tours of the old courthouse, tours of the Congress Hotel.  There will be one of John Dillingers Cars on display at the train depot and the old theater down town will show Gangster movies for 3 days.  We can thank Dillinger for getting Frank Eyman involved in the FOP.  Frank Eyman was one of the Tucson officers that had to go back east to testify in court and while there he was invited to speak at a "FOP" meeting.  He was so impressed with the FOP he started one in Tucson after he returned.  Some of the pictures I have, and need to get people ID'd are FOP pictures.  I have been a member of Fop Lodge #1 since 1967.  Well I guess I have bored you long enough, again thanks for sending me the picture.  Stan Benjamin #5138

Mr. Letcher is scheduling town hall meetings with city employees and retirees to provide an update on the budget deficit facing the City in Fiscal Year 2011-2012.  The City at this time projects the  budget shortfall next year will be $51 million if the "Core Tax" is not approved by voters of Tucson in November.

 

Mr. Letcher will make a short presentation and have a question and answer session to clarify questions retirees may have.

 

On September 8th, the Core Tax Committee will recommend additional  severe budget cuts to Mayor and Council in the event the sales tax increase is not approved.

 

On September 20th, Mr. Letcher will brief retirees what the budget situation will be if the sales tax is approved and identify deeper budget cuts necessary if the one-half-cent sales tax is not approved.

        The F.O.P. scored a major legislative victory when the Senate passed H.R. 4, the "Pension Protection Act of 2006," by a 93-5 vote. This came after the House approved the bill 279-130. The bill eliminates the Deferred Retirement Option Plans (DROP) tax penalty provision, and includes the "Healthcare Enhancement for Local Public Safety (HELPS) Retirees Act," both of which the F.O.P. had been lobbying for quite some time now.

        "The bill is a major victory for our officers, many of whom are hurt by the DROP tax penalty provision and have trouble affording decent health insurance," National President Chuck Canterbury stated. "Many of our officers are forced to retire earlier than the rest of the general population and are unfairly penalized because of this. This bill will help end this and save many of our officers a great deal of money."

        The DROP provision, which is included in section 828 of H.R. 4, would eliminate the ten percent (10%) early withdrawal penalty from a government defined benefit plan for public safety officers participating in Deferred Retirement Option Plans (DROP). Under current law, a law enforcement officer who leaves active service before the age of 55 and opts to receive a lump-sum payment under DROP before the age of 59 ½ is subject to an early withdrawal penalty of ten percent (10%).

        The HELPS provision, which is included in Section 845 of H.R. 4, would provide a modest tax benefit to help retired public safety officers afford health insurance by allowing the use, on a pretax basis, of up to $3,000 annually from their pension funds (including defined benefit plans and defined contribution plans) to pay for premiums on health care and long-term care insurance.

        The Fraternal Order of Police is the largest law enforcement labor organization in the United States, with more than 324,000 members.

        Penalty-Free Withdrawals for Public Safety Employees

        Police officers, firefighters and emergency medical technicians can now take penalty-free retirement plan withdrawals as early as age 50 (down from age 55) if the employee separates from service and he or she participates in a government pension plan with a Deferred Retirement Option Plan (DROP) benefit feature. My name is Lorraine Thompson and one of your customers "Platinum Online Group" deposited an unauthorized check of mine in the amount of $49.89.  The back of the check shows your banks name and the numbers 0124303049 and 0044 5337 389800.  It also has "For deposit only, Platinum Online Group, 0121016059.  Now, I did not authorize this fraudulent company to make a check from my account and I don't know how in thw world they got my account number.  I have telephned the phone number on the front of the check, 818-255-9973 and everytime I get a message operator who only takes a message and the company never calls back.  I am not the only victim of this fraud, there are numerous other victims.  You should be aware there could be problems with your bank allowing this type of fraud to people.

This past Tuesday, we had our emergency meeting which was intended to provide current information related to potential layoffs, the budget deficit, and the current status of the department. Chief Villasenor was invited to attend and make his presentation to our members and answer the hard questions. I thank him for coming out and doing so.

There were a lot of questions as you can imagine, mostly pertaining to what would occur if the Core Service Tax did not pass in the November election. Our "younger" members inquired as to how far back would layoffs go, and some asking if they should be looking for other employment. Obviously, without have all the facts and considering all the variables, it was difficult for the Chief (and me) to give exact answers to some of these questions; however, the Chief understood their concerns and respectfully expressed his desire for officers to do what is right for them and their families. Following the questions and answers, the Chief directed Captain Gillooly to make sure that the Intranet's "Chief's Corner" is updated with information/data pertaining to the questions asked at this meeting. I urge you all to visit this site frequently to get the Chief's perspective.

Following this, I briefed those who attended the meeting on the current status of the Core Service Committee and recent meetings I've had with City staff. The CSC has continued to meet during this month and has been provided information/data from city directors on what they would have to cut with a 15% reduction to their respective operational budget. Every presentation has shown severe personnel cuts. Unfortunately, the CSC has not even discussed revenue generators or cuts to outside agencies or any other ideas even though they must bring forward all recommendations to Mayor & Council's study session on Wednesday, September 8th. I would strongly suggest everyone attend this meeting and hear what leaders of the CSC recommend. Again, it has been very difficult to answer all your questions because this committee, who has been granted a lot of power, has yet to complete a "Plan B" strategy.

So, with all that said what are we doing about the Tax? Over the next few days, VP John Strader, Grievance Chair Mike Gurr, and I will be working on pro/con language to get to you, along with the actual ballot language, so you can review it for yourself and make an educated decision on whether or not we officially endorse this tax. We will be having a Membership Vote on Thursday, September 2, from 07-1900 hours at our office located at 333 W. Ft. Lowell, suite 211. You must be present to cast a vote, no exceptions. FSB personnel are allowed to vote on-duty with supervisor approval and call load permitting.

I know this time has been frustrating, and I know that many are extremely concerned about your future with the department. It deeply pains me to think of what would take place if this city cannot save itself and both the department and our personnel fall victim. I ask in these trying times of all those who are out there working the streets to remain focused on staying safe and taking care of each other as we continue through the next several months.

Attached you will find a draft of an Information Kit that the NFOP will be
distributing in its final form to all lodges. This kit contains advice on
how to mobilize volunteers, write letters to news outlets, issue press
releases, and other valuable information that can be used in this fight.
This kit when finished will include information on SavePublicSafety.com, the
new web site that we will be launching in the coming weeks. We will be
providing information to assist with this fight on SavePublicSafety.com,
including three videos. One video is designed to be motivational to our
members to encourage them to get involved in your efforts. Two videos will
be 15 second spots that could be used by lodges as commercials. All three
videos are still in production, however we would ask you to look at the
first two and provide your feedback. They are rough cuts, but they will give
you an idea of where we are headed with this campaign. Please listen to the

Thanks for sending out the history information on Tucson Lodge 1 and the
State Lodge.



I was reformatting the information for our lodge newsletter and did a little
research to add to your information.  I also found some photographs of Eyman
on the Pima County website, which I included.  I've attached the reformatted
article and photos in case other lodges want the information.

It is a Great milestone when an organization is celebrating 75 Years.
February 24, 1936 to February 24, 2011



Happy Anniversary to the members of Tucson Lodge 1 and the State Lodge  and
all the members who make up the  AZ. F.O.P. !!!!



Some Background:

Frank Eyman- Who was a Tucson Police Officer, than later became the Sheriff
of Pima County and from 1955 to 1972 was the Warden of the Arizona State
Prison in Florence, brought the FOP to Arizona. You can say that Frank Eyman
is the father of the Arizona F.O.P.



On January 25,1934, Tucson Police Officer Frank Eyman  who was one of
several officers who captured John Dillinger in a Hotel in Downtown Tucson
and then transported Dillinger to Chicago. While in Chicago, he had the
opportunity to visit an Fraternal Order of Police Lodge, he returned to
Tucson with paperwork to establish the first F.O.P. Lodge in Arizona.



The Grand Lodge was contacted and on February 24, 1936 after traveling by
train from Ohio, Grand President Joseph H. Pence arrived in Tucson. Grand
President Pence was the first  Grand President to be elected who was not
from Pennsylvania and served one year. (1935-1936). During his term he sworn
in 30 new F.O.P. Lodges.



At the meeting in Tucson, Grand President Pence conducted the initiation of
the new members by Ritual. After all were initiated (the first F.O.P.
members in the West) an election was held and he then swore in the First
F.O.P. Lodge Officers  West of the Mississippi River, Tucson Lodge # 1.
After  the new Board Officers were seated another election was held by a
motion and a second and the motion was passed that all the Officers of
Tucson Lodge # 1 were elected as the First Arizona State Lodge Officers.
Grand President Pence then swore in the new State Lodge Board Officers.
Another milestone, the AZ. State Lodge was the first State Lodge West of the
Mississippi.



In the trophy case in the Metro Lodge, located at 3445 N. Dodge Blvd. is the
Charter of the Tucson Lodge 1 signed by the members of the Lodge and the
Charter of the Arizona F.O.P. State Lodge signed by the elected Officers,
both Charters were signed by Grand President Pence and it was official.



Later that year (1936) Phoenix Lodge # 2 was installed and in the first part
of 1937 Cochise Lodge # 3 was installed and it has continued, some lodges
have come and gone and several have merged and currently there are 37 F.O.P.
Lodges State wide.

Just a short note to try and keep everyone informed. Today, our State FOP President is speaking before the State Legislature against the bills being brought forward against our retirement system. Jim Mann, our State FOP/ALC director is in Washington DC talking with the National leadership about the same issue. I keep getting asked why we are not doing more publically to defend our own. We have had discussions with our State Reps about that very thing. What we have been told is that now is not the time to rattle our swords. If we make a show of force, we will just demonstrate to the public that their perception of us is correct. Our State Leadership feels our tact of dealing with congress on a more personal level is the right way to go now. In the future, might we need to come together, send letters and/or phone calls to Legislative members, sure, but not yet.  House bill 2726 introduced by Rep Kirk Adams is the vocal point of the current attack. I would encourage all to read the bill at http://www.azleg.gov/FormatDocument.asp?inDoc=/legtext/50leg/1r/bills/hb2726p.htm.

There will also be a bill of similar type coming out of the Senate soon. Rest assued, we continue to  monitor the situation and I'll try to keep all informed.

Just FYIÃ¢Â¦ Today, The Public Safety Personnel Retirement System (PSPRS) Board of Trustees voted negotiate and approve a new contract intended to retain Mr. Hacking as the PSPRS Administrator.

Previously, the Board of Trustees had not made the employment offer to Mr. Hacking, expressing an intent to interview applicants for the position.

Basically, there have been several changes to the BoardÃ¢s appointed members, which led to todayÃ¢s action.

It is my opinion, the PSPRS TrusteeÃ¢s vote to retain Mr. Hacking as the PSPRS Administrator is a very good decision.

As a side note, legislation which changed the name from Ã¢Fund ManagerÃ¢ to the new name of Ã¢Board of TrusteesÃ¢ also increased the number of appointed Trustees from five to seven. The two new positions are to be appointed as a 2nd Ã¢member of the publicÃ¢ and a 2nd Ã¢member of a local retirement board.Ã¢

This census form has sure gotten the American population upset. I think many of the problems stems from the fact that the US Government has problems protecting the data bases it currently has. As a veteran I know several years ago I got a notice telling me that hundreds of thousands of Veteran's Affairs records had been compromised. Many of us have seen how social security numbers stored on governement computer data bases have also been broken into.

I personally don't feel comfortable giving the census all that information. My date of birth has absolutely no bearing on tax or political districting information etc. Merely asking your age to the closest year may be appropriate. Does being of a particular ethnic background make anyone less or more an American?

The census form should have only one question, "How people live in your house?". It should be done online to save countless millions of our tax dollars. And there is no need to waste money by mailing us a notice telling us a census form will be coming soon.

Maybe we need to have to National FOP voice our member's concerns to the federal government.

Civil Disobedience and the Census

I recently heard someone say the time has come for some civil disobedience and the intrusive nature of the Census makes it the perfect place to start. I could not agree more. The American people need to draw a line in the sand and tell the reprobates in the federal government we will no longer tolerate their usurpations of power.
If the American people are going make a stand and go toe to toe with the federal government, then they need a basic understanding of some constitutional principles because these principles are universal and pertain to every power exercised by the federal government.
Constitutional Principles
Principle No. 1. The Constitution established a separation of power between the States and their federal government. James Madison explained this principle in Federalist Essay No. 45:

The powers delegated by the proposed Constitution to the federal government are few and defined. Those which are to remain in the State governments are numerous and indefinite. The former will be exercised principally on external objects, as war, peace, negotiation, and foreign commerce; with which last the power of taxation will, for the most part, be connected. The powers reserved to the several States will extend to all the objects which in the ordinary course of affairs, concern the lives, liberties, and properties of the people; and the internal order, improvement, and prosperity of the State.

The operations of the federal government will be most extensive and important in times of war and danger; those of the State governments in times of peace and security.

In the New York State Convention debating ratification of the proposed constitution in 1788, John Jay, who was one of the authors of the Federalist Essays and would later become a justice of the United States Supreme Court, expressed this principle as follows:

What are the objects of our state legislatures? Innumerable things of small moment occupy their attention; matters of a private nature, which require much minute and local information. The objects of the general government are not of this nature. They comprehend the interests of the states in relation to each other, and in relation to foreign nations.

Thomas Jefferson discussed this principle in various writings throughout his political career. In 1816 he wrote:

The best key for the solution of questions of power between our governments is the fact that Ã¢every foreign and federal power is given to the federal government, and to the states every power purely domestic. * * * The federal is, in truth, our foreign governmentÃ¢Â¦

The federal government was empowered to deal with foreign affairs and relations between the States while the States would concern themselves with domestic affairs.
The powers of the federal government are commonly known as delegated powers because when that government was established, the States delegated, not surrendered, a portion of their sovereign powers to the federal government. The powers not delegated to the federal government are known as reserved powers.
Principle No. 2. The Constitution established a federal government of limited enumerated powers. Under this system of government, every power not granted to the federal government and enumerated in the Constitution is denied. This principle is the foundation of the Constitution and exists independent of the Tenth Amendment. That Amendment is merely a secondary level of restraint on the powers of the federal government.
In Federalist Essay No. 14, James Madison wrote that adoption of the proposed constitution would not grant the federal government general legislative authority throughout the United States:

[I]t is to be remembered that the general government is not to be charged with the whole power of making and administering laws. Its jurisdiction is limited to certain enumerated objectsÃ¢Â¦

Alexander Hamilton addressed the principle of limited government in Federalist Essay No. 83:

The plan of the convention declares that the power of CongressÃ¢Â¦shall extend to certain enumerated cases. This specification of particulars evidently excludes all pretension to a general legislative authority, because an affirmative grant of special powers would be absurd, as well as useless, if a general authority was intended.

The federal government only exists within the sphere of its delegated powers and is constitutionally powerless to act absent a specific grant of power. It should be noted that there are no implied powers beyond the delegated powers. For example. Congress has been granted Ã¢the power to establish post offices.Ã¢ Therefore, Congress can pass any law necessary to the establishment and maintenance of post offices. This would include such incidental powers such as printing stamps, affixing their value, appropriating money for postal trucks, etc.
Members of Congress constantly attempt to reverse this principle. I have lost count of the number of times I have watched one of these clowns hold up a copy of the Constitution and claim their powers are unlimited except in those instances were the Constitution places a restriction on their power. These individuals are either corrupt, incompetent, or both.
Principle No. 3. Constitutionally, the federal government cannot use its delegated powers to encroach on the powers reserved to the States. In other words, the federal government cannot convert its federal and foreign powers into domestic powers to do things not entrusted to that government, i.e., use principle No. 2 to circumvent principle No. 1.
Constitutional Provisions for the Census
The provision for the Census is found in Article I, Section 2, Clause 3 of the Constitution. It is confined to determining the number of Representatives [in the House] and imposing direct Taxes among the several States.

Representatives and direct Taxes shall be apportioned among the several States which may be included within this Union, according to their respective NumberÃ¢Â¦ The actual Enumeration shall be made within three Years after the first Meeting of the Congress of the United States, and within every subsequent Term of ten Years, in such Manner as they shall by Law direct.

The reader will note the power to make laws concerning the Census is restricted to the Ã¢actual enumeration.Ã¢
In the case of direct taxes (a direct tax is a tax on property based on ownership), this provision requires Congress to apportion the tax among the individual States based on population. For example. LetÃ¢s say in 1790, two years after the ratification of the Constitution, Congress prepared a budget and decided to impose a direct tax to raise the needed revenue. And, based on the Census, Virginia had 30% of the population of the United States. Under the rule of apportionment, Virginia would have been responsible for 30% of the tax. The States collect the tax and turn the money over to the federal government.
Direct taxes are inherently unfair because one State, with ten percent of the population, might be one of the richest States while another State, with the same percentage of the population, might be one of the poorest. Yet, under the direct tax formula imposed by the Constitution, both States would be required to pay the same amount. The Founders feared the use of direct taxes so they created a system to discourage their use.
Since direct taxes must be apportioned based on population, an enumeration is needed to determine the percentage of tax for each State.
The Federal Government Distorts the Purpose of the Census
On their web-page, the Census Bureau explains the purpose of the Census as follows:

The U.S. Constitution (Article I, Section 2) mandates a headcount of everyone residing in the United States. The population totals determine each stateÃ¢s Congressional representation. The numbers also affect funding in your community and help inform decision makers about how your community is changing.

The reader will note that the federal governmentÃ¢s statement of purpose does not comport with the Article I, Section 2, Clause 3 of the Constitution. Since decisions about our communities are not within the class of powers granted to the federal government (see constitutional principle No. 1), the reader will not find a reference to it in the limited powers granted to the federal government (see constitutional principle No. 2).
No More Census Long Forms
On their web-page, the Census Bureau states the long form used in the past has been replaced with a new short form:

In the past, most households received a short-form questionnaire, while one household in six received a long form that contained additional questions and provided more detailed socioeconomic information about the population.

The 2010 Census will be a short-form only census and will count all residents living in the United States as well as ask for name, sex, age, date of birth, race, ethnicity, relationship and housing tenure Ã¢ taking just minutes to complete.

The more detailed socioeconomic information is now collected through the American Community Survey. The survey provides current data about your community every year, rather than once every 10 years. It is sent to a small percentage of the population on a rotating basis throughout the decade. No household will receive the survey more often than once every five years.

The reader will note that the additional information requested on the 2010 form will have absolutely nothing to with apportioning direct taxes or determining the number of representatives in the House of Representatives.
The American Community Survey
As stated above, the Census Bureau will be using the American Community Survey to extract personal data that it previously received on the old long form. Once again, this information will have absolutely nothing to with apportioning direct taxes or determining the number of representatives in the House of Representatives.
Authority for the Census and the American Community Survey
On their web-site, the Census Bureau claims the American people are Ã¢required by lawÃ¢ to provide the information requested on either form and our response is Ã¢mandatory.Ã¢
For the Census, they cite the provision of the Constitution referenced above as their authority to request the information.
For the American Community Survey, they cite Title 13, United States Code (U.S.C.), Sections 141 and 193 as their authority to request the information.

Section 141 (d) states, in part: Ã¢Â¦the Secretary, in the year 1985 and every 10 years thereafter, shall conduct a mid-decade census of population in such form and content as he may determineÃ¢Â¦

Section 141 (e) (2) states: Information obtained in any mid-decade census shall not be used for apportionment of Representatives in Congress among the several States, nor shall such information be used in prescribing congressional districts.

Section 141 (g) As used in this section, Ã¢census of populationÃ¢ means a census of population, housing, and matters relating to population and housing.

Section 193 states: In advance of, in conjunction with, or after the taking of each census provided for by this chapter, the Secretary may make surveys and collect such preliminary and supplementary statistics related to the main topic of the census as are necessary to the initiation, taking, or completion thereof.

The first thing reader should note is the difference between the statement of authority for the 2 surveys. The Census falls under the Constitution while the American Community Survey is merely based on a statute passed by Congress.
The second thing the reader should note concerning section 141 is the reference to a mid-decade census of population. There is no constitutional authority for mid-decade census. See again Article I, Section 2, Clause 3 of the Constitution.
The third thing the reader should note concerning section 141 is the statement that the information obtained from the mid-decade census cannot be used for the constitutional purpose of the actual Census.
The fourth thing the reader should note concerning section 141 is the statement that the mid-decade census is being used for housing, and matters relating to population and housing. Article I, Section 2, Clause 3 does not contain a grant of power concerning these subjects.
This takes us to the other section cited as the authority for the American Community Survey. Section 193 restricts census surveys and the collection of preliminary and supplementary statisticsÃ¢Â¦to the main topic of the censusÃ¢Â¦necessary to the initiation, taking, or completion thereof. Constitutionally, the only topic of a census is a head count for apportioning direct taxes or determining the number of representatives in the House of Representatives. Article I, Section 2, Clause 3 does not contain a grant of power for any other census. The other ones referenced in section 193 fail to meet the constitutional topic of the only census enumerated in the Constitution.
Note: See again the first 2 constitutional principles discussed at the beginning of this article and then apply them to the American Community Survey.
Penalty Provisions for Failure to Comply with Either Survey Request
On their web-site, the Census Bureau states the penalty provision for failing to comply with either survey request is found in Title 13, U.S.C., Section 221.
Pursuant to this section, refusing to provide the requested information or neglecting to complete either survey subjects you to a fine of not more than $100.00. Willfully giving information that is false subjects you to a fine of not more than $500.00.
Then, in what I believe is a blatant attempt to misrepresent federal law and install fear in the hearts and minds of the American people so they will provide the requested information, the Census Bureau included the following statement after their reference to the section 221 penalties referenced above:

Title 18 U.S.C. Section 3571 and Section 3559, in effect amends Title 13 U.S.C. Section 221 by changing the fine for anyone over 18 years old who refuses or willfully neglects to complete the questionnaire or answer questions posed by census takers from a fine of not more than $100 to not more than $5,000.

A review of Title 18 shows it is entitled:Ã¢CRIMES AND CRIMINAL PROCEDURE.Ã¢
Section 3559 is entitled: Ã¢Sentencing classification of offenses.Ã¢ Section (a) states: Ã¢Classification.Ã¢An offense that is not specifically classified by a letter grade in the section defining it, is classified if the maximum term of imprisonment authorized isÃ¢(9) five days or less, or if no imprisonment is authorized, as an infraction.
Section 3571 is entitled: Ã¢Sentence of fine. Section (a) states: Ã¢A defendant who has been found guilty of an offense may be sentenced to pay a fine.Ã¢ Section (b) states in part: Ã¢Ã¢Â¦an individual who has been found guilty of an offense may be fined not more than the greatest ofÃ¢(7)for an infraction, not more than $5,000.Ã¢ This is the only reference to a fine in the amount cited by the Census Bureau that matches the provision in section 3559 above.
The $5,000.00 fine referenced in section 3571 is a post conviction fine that only applies to an individual who has been charged and convicted of a criminal infraction as defined in section 3559. Unless an individual has been charged and convicted of some criminal offense connected to the Census and the crime is classified as an infraction, this $5,000.00 fine does not apply. Thus, their assertion that these sections changed the fines in section 221 to $5,000.00 isÃ¢Â¦you fill in the blank. In my mind, itÃ¢s a blatant lie that borders on fraud.
My Rules and Plan of Attack
Here are the 3 basic rules I follow when I receive requests for personal information on the Census and/or American Community Survey forms.
* I never destroy or deface the forms.
* I never put false information on the forms.
* I never partially complete the forms. If I am going to make the assertion that the requested information does not apply to me or the requested information exceeds the governmentÃ¢s constitutional authority to request the information, I return the form with a cover letter explaining why.
Here is my plan of attack for the Census and American Community Survey forms.
When I receive the 2010 Census form I will return it with a cover letter. In the letter I will give them the number of people residing in the house and state that pursuant to Article I, Section 2, Clause 3 of the Constitution that is the only information they are empowered to request. My Ã¢name, sex, age, date of birth, race, ethnicity, relationship and housing tenureÃ¢ have absolutely nothing to with apportioning direct taxes or determining the number of representatives in the House of Representatives. Therefore, neither Congress nor the Census Bureau has the constitutional authority to make that information request a component of the enumeration outlined in Article I, Section 2, Clause 3. In addition, I cannot be subject to a fine for basing my conduct on the Constitution because that document trumps laws passed by Congress. Period end of story.
When I receive the American Community Survey form, I will return it with a cover letter. The letter will simply state that since the Constitution established a federal government of limited enumerated powers and that document does not grant them the general power to request the information, I am under no constitutional obligation to provide it.
If they attempt to distort the law and threaten me with the bogus $5,000.00 fine, as discussed and exposed above, I will send a letter to the Justice Department and request prosecution of the individuals making the threat.
The Coup de Gras to their Unconstitutional Information Requests
Even though I do not like to cite court cases, I either attach this one to my letter or hold it in reserve to support my refusal to comply with their bogus requests because it usually ends the discussion and any threat of a fine.

Ã¢Neither branch of the legislative department [House of Representatives or Senate], still less any merely administrative body [insert Census Bureau], established by congress, possesses, or can be invested with, a general power of making inquiry into the private affairs of the citizen. Kilbourn v. Thompson, 103 U.S. 168, 190. We said in Boyd v. U.S., 116 U. S. 616, 630, 6 Sup. Ct. 524,Ã¢and it cannot be too often repeated,Ã¢that the principles that embody the essence of constitutional liberty and security forbid all invasions on the part of government and itÃ¢s employees of the sanctity of a manÃ¢s home and the privacies of his life. As said by Mr. Justice Field in Re Pacific Ry. Commission, 32 Fed. 241, 250, Ã¢of all the rights of the citizen, few are of greater importance or more essential to his peace and happiness than the right of personal security, and that involves, not merely protection of his person from assault, but exemption of his private affairs, books, and papers
from inspection and scrutiny of others. Without the enjoyment of this right, all others would lose half their value.Ã¢Ã¢ [The bracketed words added for clarification]

Interstate Commerce Commission v. Brimson, 154 U.S. 447, 479 (May 26, 1894)
Note: This United States Supreme Court case has never been overturned.
If the federal government had been granted the general power to make inquires into the private affairs of the American people through the Census or a congressional mandated survey, then the Supreme Court could not have made this statement.
Now that we know the federal government was not granted the constitutional authority to make general inquires into our private affairs under the umbrella of the Census or a survey, I hope the American people will consider engaging in some civil disobedience and refuse to comply with these unconstitutional requests.

Hi Brandon,

Just wanted to let you know John is at his old tricks again. I don't know why he does not include the entire eboard for his requests. He used to do that to me all of the time and that is why we got into it several times because I let him know what the protocols were and he did not like me telling him what to do.

Also, when the information came out about the DPS Officer I sent John Ortolano an email of condolences on behalf of Lodge #1 as the Immediate Past President. When these things happen I think we should have one person, either you or John send out emails to the pertinent Lodge.

I think John gets frustrated because you do not respond as quick as he would like you to but you need to tell him you respond when you can and are not just blowing him off. And as far as his request to donate funds he forgets to include the entire eboard. When I was president he always used to send the request to Nick and Sue, he never included me as the President. He knows the protocol and he insists on doing it this way and knows the two people he sends it to will forward to the appropriate people.

I 'am requesting an immediate donation to the Marano family of $1000. Last Saturday at the State Board meeting Ted Kulkens of Douglas Lodge asked about the contract. He said he never received any messages on his phone from you regarding the signing of the contract. His Lodge wants to be in the coalition. I told him that you were on a deadline and needed him to contact you by the end of August. He remains with his claim he did not get any messages. I don't know if we can still add his lodge but when we were negotiating the last contract and Pima #20 were going back and forth whether or not they wanted in, we added them into the contract then took them out of the contract when the presidents had already signed. Maybe we can call Judy and ask her if Douglas Lodge can be added to the contract. What do you think? Let me know and I can call Judy at Xentel and ask her.

When this all came out last year none of thier members seemed to worried that TPOA might be crooked. But now that it is out in the open and the indicments have come down we might want to think hard about recruitment.

Oh, and registering a Trademark through the U.S. Patent and Trademark office costs $325 per trademark. That would be $650 for the shopping name and breakfast with santa. Still, not a bad deal considering the company that owns shop with a cop wanted almost that much every year.

If we are going to trademark a name I donÃ¢t think we can use FOP in the title as the Grand Lodge already owns that. However, after we trademark a name IÃ¢m sure we can use FOP in front of that name. I also think Ã¢FOP Cops, Kids, and ChristmasÃ¢ is a little busy. Shop with a Cop and Breakfast with Santa are simple but get the point across. ThatÃ¢s why I suggested Christmas with a Cop. Anyways, if we decide to go with FOP Cops, Kids, and Christmas there shouldnÃ¢t be a problem if we just trademark Cops, Kids, and Christmas. Let me know.

This memo is to advise after researching her Judicial Rulings and her history as a prosecutor that I will announce June 9, 2009 that the National Fraternal Order of Police will endorse her appointment to the court.

The materials attached were put together from various sources and the Executive Board held a teleconference and discussed this issue. There was unanimous support for this endorsement.
