CADVision Sues Telus (Update) Back

CADVision Development Corporation, a Calgary Internet Service Provider with 35,000 subscribers, commenced action in the Court of Queen's Bench of Alberta against Telus Corporation ("Telus"), Telus Communications ("TCI") and Telus Advanced Communications ("TAC") on November 19th, 1997 seeking injunctive relief and, in the alternative, damages. CADVision alleges Telus, TCI and TAC are treating it in a discriminatory manner by not providing CADVision equal access to ADSL Voice Over Data Service. CADVision's application was heard before Justice H.S. Prowse of the Court of Queen's Bench of Alberta at 10:00 am, Wednesday, December 17.

CADVision has also sought similar relief from the Canadian Radio Television Commission ("CRTC") and a decision of the CRTC is expected in the upcoming weeks. In light of the pending decision from the CRTC, Justice H.S. Prowse adjourned CADVision's application until Friday, January 2, 1998. In addition, the Court of Queen's Bench also ordered an interim injunction against Telus, TCI and TAC preventing TCI from launching ADSL Voice Over Data Service until the parties appear before the Court January 2, 1998.
