FREE RADIO BERKELEY 104.1FM JULY/AUGUST '98 BI-MONTHLY NEWSLETTER Free Radio Berkeley at 104.1FM went off the air on June 16, 1998 after Federal Judge Claudia Wilken granted the FCC an injunction. ----------------------------------------------------------------------------- On Sunday evening, June 21st, a broadcast was heard from a mobile unit at 8pm in commemoration and to encourage free speech on the airwaves. By 8:15 the transmitter had been located by two FCC agents and the outdoor broadcast was shut down at 8:28pm. ----------------------------------------------------------------------------- The Mission: Free Radio Berkeley exists to provide a voice for the diverse community in the greater Berkeley/Oakland area. Further, it is a vehicle and a means by which to bring about radical social change. Consistent with a vision of creating an alternative, diverse, vibrant society and community that respects the right to be free of sexism, racism, homophobia and all other forms of oppression, FRB programming will be reflective of those goals & ideals. We have been forced off the air but we still hold true to our Mission. ----------------------------------------------------------------------------- Our lawyers have filed a motion for reconsideration of the injunction ruling. Tentative date for oral hearings is August 7th at the Oakland Federal Bldg. ----------------------------------------------------------------------------- We will soon be broadcasting live on the internet (www.freeradio.org). We hope to make computers with internet sound capability available in locations throughout Berkeley so people without computer and internet access will be able to hear our shows. And we will not submit to an infringement of our First Amendment Rights!!! ----------------------------------------------------------------------------- This is the text of a press release that went out on 6/20: Procedure Be Damned - Free Speech Is the Issue Judge Wilken's decision, based on narrow procedural grounds, is a slap in the face of free speech and amounts to prior restraint. Neither I nor the micropower broadcasting movement will be silenced by this injunction. It only encourages me to intensify my efforts in the creation of a truly democratic grass-roots broadcast media and facilitate the citizens of this country taking back what rightfully belongs to them - the airwaves. My attorneys, Luke Hiken and Alan Hopper, will be filing a motion to challenge this extremely flawed ruling which insists that one must, first, take part in an obviously futile process before constitutional standing can be established. For 64 years, the FCC has stood for the protection of corporate interests and profit, not the first amendment. To hell with the FCC, NAB, and corporate control. We are going to reclaim our rights and resources through an ever-increasing campaign of electronic civil disobedience and direct action. Free speech by any means necessary. The zoning board unanimously granted our use permit even while being threatened by the CBA (California Broadcaster's Association). Show your support by getting your friends & neighbors to sign a petition which can be sent to the FCC & used as proof of our community's endorsement of Free Radio Berkeley and the First Amendment. - Call the FCC at (510) 732-1633 to voice your disapproval of the situation and to stand up for Free Speech. Nick Johnson of the FCC professes that he is interested in input on creating standards for micropower broadcasting.
