The Canadian Human Rights Commission has received a complaint from the Toronto Mayor's Committee on Community and Race Relations alleging discrimination on the grounds of race, religion, and national or ethnic origin, contrary to section 13.(1) of the Canadian Human Rights Act. A copy of the complaint form and attachments are enclosed for your information.

Penny Goldrick has been assigned to investigate this complaint and to submit a report on the investigation findings to the Canadian Human Rights Commission. She will be in touch with you or your representative in the near future to obtain information related to the allegations in the complaint. In the meantime, could you please submit to the investigator the name, address and telephone number of the person who will be your official representative in this matter, as well as your position regarding the allegations, and copies of any related documents. I would also like to draw your attention to section 48 of the Canadian Human Rights Act which allows the parties to settle a complaint in the course of investigation. The investigator will be pleased to discuss the possibility of a settlement with you or your representative at any time.

COMPLAINT FORM

ALLEGATION

We, the Mayor's Committee on Community and Race Relations, have reasonable grounds for believing that Ernst Zundel is discriminating against persons or groups of persons on the grounds of race, religion, national or ethnic origin, by placing on the World Wide Web (W.W.W.) messages which are likely to expose a person or persons to hatred or contempt by reason of the fact that that person or those persons are identifiable on the basis of a prohibited ground of discrimination, contrary to section 13(1) of the Canadian Human Rights Act.

PARTICULARS

From October 10, 1995, and continuing, a Homepage on the W.W.W. offered by Ernst Zundel, 206 Carlton Street, Toronto, Ontario, M5A 2L1, has repeatedly provided a full text of several pamphlets, including, "Did Six Million Really Die?" the full text of the publication :66 Questions and Answers on the Holocaust", the full text of an article, "Jewish Soap", and at least ten other documents, which we believe are likely to expose persons of the Jewish faith and ethnic origin to hatred and contempt. Attached to this complaint form are examples of the messages available on the Homepage.
